VA T4NG2 court case continues with two dozen protests remaining

The Veterans Affairs Department has added three protesters to the pool of winners, but 24 unhappy bidders face a July 14 deadline to decide whether to continue their legal fight.

One company has dropped its legal challenge involving the Veterans Affairs Department's massive T4NG2 contract, but two dozen protests remain open at the U.S. Court of Federal Claims.

360 Innovative Solutions has asked the court to dismiss its protest after VA decided to award three protestors spots on the potential $60 billion Transformation Twenty-one Total Technology Next Generation 2 vehicle.

Peregrin, Taurian Consulting and Technatomy now have positions on the contract following their protests.

That left 26 companies with decisions to make about whether to continue their protests and 360 Innovative Solutions decided to drop out.

Judge Molly Silfen gave the protestors a July 14 deadline to file amended complaints if they want to continue their legal arguments.

With 360 Innovations dropping out, that leaves 25 companies that can continue their fight.

VA has said it will not begin awarding task orders under the vehicle until March 2026, which would give the court time to rule on the remaining protests.

One indicator that the case will continue is that several companies have filed motions with the court to grant their attorneys access to protected materials.

The requests came from both the protestors and intervenor-defendants, which are companies that have won spots on T4NG2 and are defending their positions on the contract.

As for the July 14 deadline: the case will be over for protesters who do not file amended complaints. We will track who does and does not file, as well as how much longer the fight will continue.
